Copyright & DMCA Policy

1. Reporting alleged copyright infringement

If you are a copyright owner or authorised to act on behalf of one and you believe that material stored in a Vodeora account infringes your copyright, send a written notice to our designated contact with the following information (consistent with 17 U.S.C. § 512(c)(3)):

1. a physical or electronic signature of the owner, or a person authorised to act on the owner's behalf, of the allegedly infringed right;
2. identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered;
3. identification of the material that is claimed to be infringing and that is to be disabled, with information reasonably sufficient to allow us to locate it (for example the specific account, source URL or playlist reference);
4. your name, address, telephone number and email address;
5. a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law; and
6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the right that is allegedly infringed.

Please send only copyright notices to this contact. Unrelated messages may not receive a response.

3. What we do with a valid notice

• We review the notice and, if it is complete and valid, disable or remove the identified material stored in the relevant account within a reasonable time.
• We make a good-faith effort to notify the affected user and provide them with a copy of the notice.
• We keep a record of notices received for the purposes of our repeat infringer policy.

4. Counter-notification

If you believe that material of yours was disabled or removed by mistake or misidentification, you may send a counter-notification to the contact above containing:

1. your physical or electronic signature;
2. identification of the material that was disabled and the location at which it appeared before it was disabled;
3. a statement under penalty of perjury that you have a good-faith belief that the material was disabled as a result of mistake or misidentification;
4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which WiseTechSoftware LLC may be found), and that you will accept service of process from the person who provided the original notice or an agent of that person.

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant informs us that they have filed a court action seeking to restrain the relevant activity.

5. Repeat infringers

WiseTechSoftware LLC will, in appropriate circumstances and at its discretion, disable or terminate the accounts of users who are the subject of repeated valid copyright notices.

6. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Do not make false claims.

7. Non-US rights holders

We provide the process above as a good-faith notice-and-takedown mechanism regardless of where you are located. If you are outside the United States, you may submit an equivalent notice with the same substantive information and we will handle it under this policy.
